Right of withdrawal

A notice:
This right of withdrawal applies exclusively to consumers within the meaning of Section 13 of the German Civil Code (BGB).
Entrepreneurs within the meaning of Section 14 of the German Civil Code (BGB) who act in the exercise of their commercial or independent professional activity are not entitled to a right of withdrawal.

Right of withdrawal for consumers

You have the right to cancel this contract within fourteen days without giving any reasons.

The cancellation period is fourteen days from the day the contract is concluded.

inform you of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or an email).
You can use the attached sample cancellation form, but you do not have to.

To meet the cancellation deadline, it is sufficient that you send the notification of your exercise of the right of cancellation before the cancellation period expires.

Consequences of revocation

If you revoke this contract, I will refund to you all payments that I have received from you, including delivery costs (with the exception of the additional costs resulting from the fact that you have chosen a type of delivery other than the cheapest standard delivery offered by me), immediately and at the latest within fourteen days from the day on which I received notification of your revocation of this contract.

For this repayment I will use the same payment method that you used for the original transaction, unless something different was expressly agreed with you; under no circumstances will you be charged any fees as a result of this repayment.

You bear the direct costs of returning the goods.

Standard shipping is personal collection of the goods at Smart Home Thomas Reh's headquarters.
Any other shipping method - especially shipping methods chosen at the customer's request, such as parcel or freight forwarding - are considered special shipping.
In the event of a cancellation, only the costs for the standard shipping method (collection = 0 EUR) will be refunded.
Additional costs for selected special shipping methods are excluded from reimbursement.

Note on impairment (Section 357 Paragraph 7 BGB)

The consumer must pay compensation for any loss in value of the goods if this loss in value is due to handling of the goods that was not necessary to examine the nature, properties and functionality of the goods.

In the case of tubular motors, controls and comparable technical components, testing the condition and functionality is only possible when they are not assembled.
Assembly, commissioning or installation in roller shutters, awnings or other systems represents use that goes beyond the handling required for testing.

If an attached seal or security label is damaged or removed, this is considered an indication of commissioning.
In these cases, we reserve the right to claim an appropriate reduction in value in the event of revocation. This is based on the actual condition of the returned goods as well as the necessary testing, cleaning and reprocessing effort.

Start of the service during the cancellation period

If you have requested that services begin during the cancellation period, you must pay me an appropriate amount which corresponds to the proportion of the services already provided up to the point at which you inform me of your exercise of the right of cancellation compared to the total scope of the services provided for in the contract. By sending in the repair or service item, the consumer expressly declares that the repair or service should begin before the cancellation period expires.
